New Scottish Regulations require disclosure of waste
statistics
The Waste Information (Scotland) Regulations 2010, require
businesses and public organisations in Scotland from January 2011
to disclose information on the waste they produce and manage.
The regulations introduce a duty to comply with a "waste
information request" made by SEPA within 28 days, and apply to both
corporate bodies and unincorporated associations.
The regulations set out the information which SEPA can
request:
- the nature of any activities of the undertaking which involve
the production or management of waste;
- the geographical locations at which any such activities are
carried on;
- descriptions of the types of waste produced by or managed in
the course of such activity;
- the quantities of waste produced by or managed in the course of
such an activity;
- the quantities of waste produced, stored, treated, disposed of
or transferred during any twelve month period in connection with
such an activity;
- in respect of any waste transferred during any twelve month
period, the initial or (where known) any subsequent destination or
holder of that waste; or
- in respect of any waste treated or disposed of during any
twelve month period, whether before or after transfer, the
treatment or disposal method, where known.
The regulations make it an offence not to comply with a waste
information request without a reasonable excuse, carrying a maximum
fine of £5,000.
