Working Time Regulations
Workers covered by the Working Time Regulations are entitled to
the offer of an annual health assessment. This is administered as a
specific questionnaire, which is screened separately to our
preemployment health questionnaire.
The Working Time Regulations do not oblige a worker to undergo a
health assessment and completion of this questionnaire should
always be a voluntary exercise on the part of each worker affected
by the Regulations.
Organisations are legally obliged to provide the opportunity of
a free health assessment in the following circumstances:
- Before commencing night work
- Transfer to night work (for an existing employee)
- At regular intervals thereafter
If a medical condition is identified as being related to, caused
or exacerbated by night work, then the employer must take
reasonable steps to modify the employee's working arrangements
and/or transfer them to working hours that would not adversely
affect their health.
You should ensure that if employees are undergoing routine
health surveillance under the Management of Health and Safety at
Work (MHSW) Regulations, they are also screened as part of these
surveillance procedures as per your risk assessments. The Company
Medical Adviser will advise you, if necessary.
Don’t fall foul of the Regulations. Ensure that every affected
worker is screened regularly.
