Many more jobs will come within the framework of “regulated activities” and require checks – not just those where Criminal Records Bureau checks already operate.

The new checks apply to any person undertaking a “regulated activity”. This includes activities which involve contact with children or vulnerable adults and are:

  • In a specified place (such as a care home or a school); or
  • Are specified activities (for example, transport or advice services) and
  • Take place frequently, intensively or overnight

A Criminal Offence

It will become a criminal offence for an employer to knowingly employ a barred person in a regulated activity.

Employers will have a duty to notify the Independent Safeguarding Authority (ISA) when they dismiss an employee or where an employee leaves prior to being dismissed in certain circumstances.
